The arrest of Steven Anderegg by the US Department of Justice represents a landmark development in the legal landscape surrounding AI-generated child sexual abuse material (CSAM). The charges against Anderegg include four counts related to the production, distribution, and possession of obscene visual depictions of minors engaged in sexually explicit conduct, as well as transferring obscene material to a minor under the age of 16.

Deputy Attorney General Lisa Monaco emphasized that CSAM generated by AI is still considered illegal under the law, underscoring the DOJ’s stance on the matter. Despite the absence of actual children in the creation process, the exploitative nature of the material remains unchanged.

According to the DOJ, Anderegg’s AI-generated images depicted nude or partially clothed minors engaging in sexually explicit conduct with adult men. The agency alleges that Anderegg utilized specific prompts, including negative prompts, to direct the AI model in producing the CSAM.

While cloud-based image generators typically incorporate safeguards to prevent misuse, Anderegg purportedly utilized a variant of Stable Diffusion with fewer restrictions. This variant, known as Stable Diffusion 1.5, was reportedly created by Runway ML and lacked the stringent safeguards found in other platforms.

The DOJ further revealed that Anderegg communicated with a 15-year-old boy online, sharing AI-generated images of minors engaging in sexually explicit behavior. Instagram reported the images to the National Center for Missing and Exploited Children (NCMEC), leading to the involvement of law enforcement authorities.

If convicted on all counts, Anderegg could face a lengthy prison sentence ranging from five to 70 years. He is currently in federal custody pending a hearing scheduled for May 22.
