After losing a legal battle to overturn its classification as a gatekeeper under the EU’s Digital Markets Act (DMA), TikTok owner ByteDance recently suffered a serious blow. The Luxembourg-based General Court, however, sided with the European Commission and dismissed ByteDance’s challenge. The court ruled that ByteDance had failed to sufficiently substantiate its arguments. The judges stated that the Commission was justified in designating ByteDance as a gatekeeper, as the company met the DMA’s quantitative thresholds concerning global market value, the number of TikTok users within the EU, and the duration over which these user thresholds were maintained.

The court pointed out TikTok’s rapid growth and popularity, which placed it on par with major rivals like Meta Platforms (Facebook and Instagram) and Alphabet (Google and YouTube). Despite competition from services like Instagram Reels and YouTube Shorts, TikTok quickly amassed a substantial user base, reaching half the size of Facebook and Instagram within the EU. This rapid consolidation of TikTok’s market position and its continued growth were key factors in the court’s decision.

This ruling reinforces the EU’s stance on regulating significant digital platforms to foster competition and protect consumers.
